Respecting your compliance obligations
Your foreign worker has finally arrived in Canada. Wonderful! Here are a few key points to always keep in mind:
1. Employment Conditions: The employment conditions you committed to the foreign worker cannot be modified. Review the guidelines regarding this matter. The salary cannot be decreased, nor significantly increased. It is your responsibility as an employer to ensure all declared conditions (e.g., job title, duties, hourly wage, location of employment) are respected at all times.
2. Health Insurance: The worker must remain insured with private medical insurance until they are eligible for the public provincial regime. Please review the policy here.
3. Work Permit Conditions: If there are conditions on the work permit, such as job title or geographical restrictions (please review the “observations” section of the work permit), they must be respected at all times.
4. Employment Insurance: Foreign workers are most often not eligible for Employment Insurance (EI). Further guidelines can be found here.
5. Housing Costs: Low-wage workers (below the provincial median wage) should never have to pay more than 30% of their gross income on rent. Details about this policy can be found here.
6. Return Flight Ticket: The employer is obligated to pay for the return flight ticket for low-wage foreign workers as per this policy.
7. Wage Verification: Please contact us annually so that we can verify if the occupation median wage has changed.
Most importantly, before making any decisions that will affect the foreign worker, please contact us !
